Have you ever had a parking fine even though you followed\nall the rules, bought a parking ticket and didn\u2019t overstay? You\u2019re not alone.\nParking companies can buy your data from the DVLA for \u00a32.50 and they are doing\nit in droves, issuing parking fines that many believe are not warranted. <\/p>\n\n\n\n

An issue on the increase <\/strong><\/p>\n\n\n\n

In 2006 272,000 parking fines were issued by private firms\nusing details they had bought from the DVLA. Fast-forward to a decade later and\nthat number has increased 25 times! This brings in a whopping \u00a317 million\nannually. It\u2019s certainly a lucrative business. So is everyone suddenly not\npaying for parking tickets or staying too long in the car parks? It seems\nunlikely! Many people are receiving fines and simply paying them. The appeals\nprocess can be complicated and lengthy with no positive result guaranteed. <\/p>\n\n\n\n

Is it legal for the DVLA to sell your data?<\/strong><\/p>\n\n\n\n

Despite the recently introduced new data rules of the\nGeneral Data Protection Regulation, it seems the DVLA are still operating\nwithin the law when it comes to selling your data on to these parking firms. To\naccess your data, the firms must be a member of an Approved Trade Association\nwith a voluntary Code of Practice and they must have reasonable cause for\ngetting your information, but there is no requirement to show any proof. So\nthey can simply pick out your vehicle and claim you didn\u2019t buy a parking ticket\nin their car park. That gives them the right to buy your details and\nconsequently send out a fine that could be up to \u00a3100. <\/p>\n\n\n\n

You agreed to this in the small print <\/strong><\/p>\n\n\n\n

The GDPR states that your information cannot be shared\nwithout your consent. The problem is, you did give your consent, even though\nyou may not realise it. When you registered your vehicle with the DVLA, in the\nsmall print of the V5 form you agreed to them sharing your data for lawful\npurposes, and your supposed bad parking is deemed to be one such lawful\npurpose. <\/p>\n\n\n\n

Will this change?<\/strong><\/p>\n\n\n\n

There are efforts underway to crack down on rogue parking\nfirms, and this issue is currently featuring widely in the press. As an\nindividual, you can make a fuss about it, share your story and tell the world,\nbut actually doing anything practical about it is pretty tough. You could of\ncourse take the parking firm to court, but you\u2019d need very deep pockets and\nunless you\u2019re very rich, it\u2019s not worth it just for the principal of it. The\nDVLA are unlikely to want to give up this lucrative revenue stream, so unless\nan external watchdog steps in to investigate and the government enforce\nchanges, we could see this practice continue into the future. <\/p>\n","protected":false},"excerpt":{"rendered":"
